PRODUCTION MUSIC FAQ

Q: What is royalty free music?
A: Music that is created to be used in audio, film and multimedia applications without the normal restrictions, fees and paperwork for use.

Q: Why the need?
A: Using music without permission or license is not legal.

Q: Why don't I recognize any of the themes I hear in your music library?
A: They are all original (or public domain) and can be found only in our production library.

Q: What is Davenport Music Library's licensing arrangement?
A: When you purchase our products, your licensing for lifetime usage is paid to us in advance. No more fees are required thereafter. See License.

Q: What can I not do with Davenport Music Library's CD's?
A: When we started 13 years ago royalty free licensing was quite simple. Now we encounter new questions daily from customers and potential customers because technology is creating some new issues by giving people new ideas for products.

We create royalty free music for use in video, audio, multimedia, public functions and numerous other areas where commercial music cannot be legally used. However, you cannot do things with our music in a couple of key areas that would cause us to compete with our own product or cause us not to be properly reimbursed. We've elaborated on a few key issues below to help clear up usage questions. 99.9% of questions posed to us are related to the following issues. If you have a question about your intended use, just call us at 1-800-951-6666.
THE OBVIOUS

NO - You cannot copy our CDs or the tracks therein and sell or give away the copies as if they were yours-no matter the media or format. (A good example of an incorrect business use of our music is if you produce "custom on hold telephone messages" for clients and you create a "music only" CD of our music to sell to them also.
YES
- Backup copies for your own personal use are allowed.
SUGGESTION - Buy from us and sell to your client at a profit.

MASS PRODUCTION -"grey area" keywords to remember.

NO - You may not mass produce in any number an audio CD (or any other media) of our music with narration to sell or give away on the open market without further licensing from us. (A good "no-no"example: You're in the "telephone on hold messaging" business and you would like to create a CD from our music, add short messages and create a product for the open market.)
YES - Demos of your services and corporate multimedia Christmas cards (with our music) of 500 or less are ordinarily excluded from this rule.
SUGGESTION - We'll be happy to license you.

INCLUDING OUR MUSIC IN YOUR MASS PRODUCED PRODUCT

NO - You may not package into your hardware, software or any other type of product copies of our music themes and then mass produce in any number to sell or give away, without further licensing from us. (A good example of this particular "no-no" is: You create a software program for computers that plays music so you decide to include some of our songs in your package for your customers. This is akin to creating a desktop publishing program and including all kinds of royalty free graphics from other programs you've bought.)
YES - You may incorporate our music into a mass produced product where it it only used incidentally (music underscores for video products, multimedia products and numerous other similar products-basically the "bread and butter" of our business).
SUGGESTION - We'll be happy to license you to do this.

FILM

N0 - You purchase a CD for $59.95 or less from us and "feature" music from our library in a commercial film or video as the underlying main theme. You make millions, people are humming the theme everythere, and we've been reimbursed practically nothing. Need we elaborate? You may not do this.
YES - You may use our music for transitional effects or as general underscore.
SUGGESTION - We'll be happy to license you to feature our music in this way.

WEBSITE

N0 - You may not post our music on your website to sell or give away via downloads.
YES - You may incorporate our music into your site for effect. If you are an "on hold messaging" company, you may post short demos of our music for your customers to choose from for their custom messages.

Call us at 1-800-951-6666 or email us if you have a usage question that does not fall in any of the above categories.

Q: Are your products guaranteed?
A: Yes. If you receive a defective CD from us, we'll replace it free. If you accidentally damaged it, send us $10 and we'll ship you a new copy.

Q: Is your music synthesized or live?
A: Mostly synthesized to sound as live as possible. Otherwise, our CD's probably would not be economically attractive.
